These Terms of Use apply to all users of the Smart Dancers Coaching platform and its courses.
By creating an account, enrolling in a course, or accessing content, you agree to these Terms.
2. Nature of the Services
Smart Dancers Coaching provides educational content related to dance training, movement, strength development, load management, and performance support.
All content is provided for educational purposes only.
It does not constitute individual medical advice, diagnosis, or treatment.
If you have an injury, medical condition, or concerns about your health, you should consult a qualified healthcare professional before participating in any training program.
3. Personal Responsibility
By participating in courses or programs offered through Smart Dancers Coaching, you acknowledge that:
You are responsible for your own training decisions.
You participate voluntarily.
You assume responsibility for how you apply the information provided.
Kinesitherapie Audrey De Bry BV is not liable for injuries or damages resulting from misuse of content or failure to seek appropriate medical advice when needed.
4. Account Access
Accounts are personal and non-transferable.
You may not:
Share login credentials.
Provide course access to third parties.
Resell or redistribute access.
We reserve the right to suspend or terminate accounts in case of misuse.
5. Intellectual Property
All content available through Smart Dancers Coaching, including but not limited to:
Videos
PDFs
Written materials
Assessment frameworks
Training structures
Logos and branding
is the intellectual property of Kinesitherapie Audrey De Bry BV.
You may not reproduce, distribute, modify, or commercially use this content without prior written permission.
Use of the materials is strictly limited to personal educational purposes unless explicitly agreed otherwise in writing.
6. Payments and Pricing
Prices are displayed in EUR.
VAT is applied in accordance with Belgian law.
If the small enterprise VAT exemption regime applies, VAT may not be charged pursuant to Article 56bis of the Belgian VAT Code.
Payment processing is handled through third-party providers such as Plug & Pay or Stripe.
7. Right of Withdrawal – Digital Content
In accordance with EU consumer law, consumers normally have a right of withdrawal within fourteen (14) days of purchase for online purchases.
For digital content made available immediately after purchase, the right of withdrawal does not apply once performance has begun, provided that:
The consumer has expressly requested immediate access to the digital content; and
The consumer has acknowledged that they lose their right of withdrawal once access begins.
By enrolling in a course that is made available immediately, the user requests immediate access to the digital content and acknowledges that the right of withdrawal is waived once access is granted.
For programs, cohorts, or services that begin at a later date, the right of withdrawal remains valid for fourteen (14) days after purchase unless access to digital materials has already been provided.
8. Refund Policy
Unless otherwise stated on a specific sales page:
Digital products made available immediately after purchase are non-refundable once access has begun, in accordance with Section 7.
For programs starting at a future date, refund requests within fourteen (14) days of purchase may be granted provided access to digital materials has not yet begun.
Nothing in this section limits mandatory rights under Belgian or EU consumer law.
9. Limitation of Liability
To the extent permitted by Belgian law, Kinesitherapie Audrey De Bry BV shall not be liable for indirect, incidental, or consequential damages arising from the use of the platform or its content.
The total liability, where applicable, shall not exceed the amount paid for the relevant course or program.
10. Platform Availability
While we aim to provide uninterrupted access, we do not guarantee that the platform will always be available without technical interruption.
We reserve the right to modify, update, or discontinue content where necessary.
11. Governing Law and Jurisdiction
These Terms are governed by Belgian law.
Any disputes shall fall under the exclusive jurisdiction of the competent courts in Belgium.
12. Changes to the Terms
These Terms of Use may be updated from time to time.
The most recent version will always be available on the platform.
Continued use of the platform after updates constitutes acceptance of the revised Terms.
